Since the Supreme Court ruled that the old security certificate legislation was unconstitutional in 2007, refugees detained under security certificates have been entitled to a detention review – but only once every six months. In fact, detention reviews rarely take place within six months and it has been over a year since the court reviewed the fact that Mr. Mahjoub is being held without charge or trial.
Mr. Mahjoub is currently under a series of restrictions that severely curtail his liberty. He wears a GPS tracking bracelet, is not allowed to go many places, cannot leave Toronto with court-appointed supervisor, cannot use cell phone or internet or any phone except the one in his house, has all his mail and phone and fax communications monitored, and more. He will ask the court to free him unconditionally and immediately.
